Silvia:
Section 364 is for trustee's. As a result, there is no real statutory authority for such a motion. You will have to allege 105. I have not done one yet, as no bank has yet demanded a court order to modify in any of my cases.
Only the most technical judge would not grant such an order.

Dear listserv
I have a client who is being granted a loan mod, however, Wells Fargo is requiring Court approval. Does the court grant these? Would anyone be gracious to share a sample.
Thanks for the input.
