Handling the Hijackings

Dear Group,
After suffering through my THIRD hijack on the same case, I started
writing letters, all of which are attached and which supplement the
NOTICE TO CREDITORS previously posted (also attached again).
This time the lender was kind enough to provide me with the name of
the lawyer who provided them with the false deed (although I haven't
gotten that deed yet).
My strategy is four-fold:
1. A letter to the lender to destroy the credibility of the source
of the false information.
2. Notify the Court (and the Chapter 13 Trustee) that there's
criminality going on, so there will not be the automatic deference to
financial institutions as "reliable sources."
3. Conduct a "noisy investigation" (the letter to the attorney who
provided the false information), and I named him here in case any of
you have also run into his law firm in this context. Note I've given
him a chance to correct the record, and if that happens, I'll send out
a correction letter immediately; however if I get a phony deed, it's
another opportunity to further damage his credibility.
4. Letter to the US Trustee fraud unit to the local US Trustee's
office.
I am VERY careful to get my facts straight. If you don't have a
broker friend, it's extremely easy to get licensed as a broker and to
make friends with a title company. I have a friend at a title company
and can get into their database any time to verify anything a client
tells me. If I get a false deed, I can look up the instrument number
on their database and get the REAL deed, which is what I'll do if
either Ocwen or Mr. Zieve provides me with the false deed and pretends
it's truthful. Of course, this puts the data source for the lender in
an awkward position; he either admits he falsified the deed, or
provides the source.
If we all take an aggressive approach to this criminality, we will
soon drive these criminals out of business. And the more names we can
provide the US Trustee, the sooner this epidemic will be stopped.
