Definition of Pending under 11 U.S.C. Section

I had the same issue recently before Judge Klein where the one prior chapter 13 case was dismissed over a year before the new case but closed within the one-year period. I filed the motion to continue stay to be on the safe side, noting I filed it as a precaution. Judge Klein ruled the motion was not necessary as the case was dismissed over one year prior.
