I have a PC where she owns an apartment building with substantial equity.
A fraudster recorded a lien against the property for money she was never
given. Judge Kaufman would like to see adversary action to quiet title and
cancellation of instrument based upon fraud. Lady is broke as a joke and
needs help. I would do it, but I don't have time and energy to reinvent a
complaint that would fit these circumstances. Anyone else have to deal
with a cancellation of instrument based on fraud? Note its pretty clearly
fraud when the notary signs a declaration that he never notarized the Deed
of Trust and the Embassy in Peru gives a certified statement that one of
the parties that was suppose to have signed the document wasn't even
present in the country. So anyone out there have a sample complaint I
could work off off and would be willing to share it?
Thank you all!
