At the trial, if your witnesses are not there for cross examination or have not submitted declarations, on the first day of trial, their declarations will be excluded and will not be allowed to testify.Suggest you call Stacy, his Courtroom Deputy for the number of exhibit binders needed and maybe even about the numbering of exhibits. You have to be really prepared for this trial and think this procedure through to avoid surprises.
