Subject: [cdcbaa] Notice question - if I e-file a motion on Saturday or Sunday do I calculate the notice days differently?
For example, if I file and serve a motion and notice on Saturday, do I start counting the 24 days beginning with Sunday? What if I file and serve on Sunday? My postal meter will stamp Sunday's date, but I don't know whether that counts when USPS doesn't work on Sundays - could I have really "served" it on Sunday?
I reviewed FRBP 2002, the local rules, and Appendix I to the Court Manual.
I don't want to get this wrong; your guidance is appreciated.

Hi Holly,
9006.Time. Don't count filing date. Include intermediate Sat, Sun, legal holidays. If day 24 falls on Sat, Sun, Legal Holiday, go forward to very next day that is NOT a Sat, Sun, Legal Holiday.
Sincerely,
Tyson M. Takeuchi, Esq.
