My understanding is that Nacba is involved and some national relief motions
will, or are likely being filed so that we may proceed with our work.
We should get some feedback from our judges on handling these matters in
the interim.

I studied the RESMAE bankruptcy and it seems that there were relief from
stay motions granted on a blanket basis in that court for all types of
issue. I bet someone somewhere could get one in that bankruptcy
authorizing all homeowners to strip and give notice to them or fashion the
appropriate relief?

GMAC Mortgage chapter 11 cases

GMAC and its ridiculous # of affiliated entities filed chapter 11 proceedings in the SDNY on 5/14/12. All of the cases are jointly administered under Residential Capital, LLC, Case No. 12020 MG.
I'm sure that every debtor lawyer on this list has debtor cases pending, with GMAC entities as creditor(s), secured by real property, in which you are seeking to avoid a junior lien or to discharge the mortgage debt. The issue that I am concerned about is whether either can occur w/o relief from stay in the GMAC cases, particularly when GMAC still owns the loan. If GMAC is merely the servicer, perhaps there is no need to be so concerned.
Any thoughts ???
Thanks,
Eric
