Subject: [cdcbaa] Getting paid by non-debtor spouse in Ch. 13 case
I have a Chapter 13 case where an elderly couple needs me to file a Ch. 11 disclosure statement and plan for an entity that owes the couple money so they can fund their Ch. 13plan. Only the husband is a debtor.ut of estate assets since she has a community property interest in hundreds of thousands of dollars listed as property in the case and also receives Social Security income? She has full powers to administer community assets under the law; so, I'm curious. I've already asked her son to fund me and he looks like he will, but I was wondering what the listserve thought about her paying me. The idea is to be able to use the funds immediately without having to wait for an employment application or a fee application.
