Having lived with the Jose Eber case since about the beginning of the Great Recession, my thoughts on the arbitration issue are that if you limit a bankruptcy court's power to determine core insolvency matters, then you greatly increase the chances of a U.S. Economy stuck in first gear for the foreseeable future - this is the real Stern v. Marshall problem in my view. Strong bankruptcy laws a well-functioning economy, and vice-versa. Put another way - let us insolvency professionals do our jobs in the Courts with specialized expertise and knowledge to handle bankruptcy issues.
And of course, it is nice to win.
