Subject: [cdcbaa] reopening of a case to list an unlisted debt
My debtor filed an asset bankruptcy in pro per in 2002. He was discharged in 2003. However, the case went on until early last year. After the administrative expenses, the unsecured creditors did not receive any distribution. The debtor failed to list his wife's community property debt and now she has a judgment. Can I reopen the case to list the wife's debt. Can I analogize this to the In Re Bizzley case because whether the unsecured creditors filed a claim or whether it was a no asset case, ultimately the result would have been the same. Thanks.
