Subject: [cdcbaa] Judgment Lien Removal Possible?
I have a strange situation. I have a PC that has a judgment lien against his home but the judgment lien was a creditor of his father who had filed Chapter 7 years ago and obtained a discharge of the debt.
My initial thought is this would likely require a quiet title action in state court by the PC son since he didn't file for bankruptcy. I think even if the father reopened the bankruptcy case, he wouldn't be able to remove the lien either since he wouldn't be able to prove that the lien impaired his exemption.
Is this analysis correct or am I missing anything? Thanks in advance.
Regards,
Tuan Le
