Subject: [cdcbaa] Judge Johnson Case
A few years back Riverside Bankruptcy Judge Wayne Johnson issued an opinion that I think was published. The issue was whether a BK filed after the foreclosure sale and before the recording of the Trustees Deed on Sale was recorded, was effective to stop the sale. I recall that Judge Johnson adopted a pro-debtor position, which I recall to be a minority position, that a BK filed before the recording of the Trustees Deed, is effective to stop the sale.
Does anyone happen to recall this case by name? Im searching cdcbaa archive posts but its slow going.
