Good day list mates,
I am settling a case. Part of the settlement involves my client deeding real property to the adverse party. Opposing counsel is worried that my client will file for bankruptcy thereafter and a trustee will clawback the property as a preferential transfer. I recall there is a mechanism we can use to alleviate their concernssomething about not dismissing the case for 90 days and holding the deed in escrow. Can anyone share settlement language with me or explain the process?
Thanks very much,
Christie Cronenweth
