Interesting case. Debtor's wife got a brain injury in a car accident with a
drunk driver. She's disabled and on SSDI. PI award will probably be $200k
to $250k. Bad luck debtor just got a $273k deficiency judgment in Illinois
from a judicial foreclosure.
Wife will need ongoing treatment and care which is estimated to be about
$300k. I know 704.140 says that the award is exempt to the extent
"necessary for the support" of the debtor. If it was just the wife it
would probably be fully exempt because the money is necessary, but debtor
makes $130k/yr.
I am going to review cases to see how this might pan out in a chapter 13
but was wondering whether any of you had dealt with a similar factual
scenario and whether the debtor was able to retain the funds for her own
care when spouse earned a sizeable income. Thanks for your input.
