Wells Fargo just called me whining that we had not included their second and
third mortgages on the Statement of Information. I thought this would be a
good time to review recently filed petitions to see what other attorneys do
with mortgage loans on the SOI. I looked at recent cases in the N. Div and
the Valley; not surprising almost everyone has a different approach.
1. some don't list real property mortgages in the SOI at all;
2. some list on the SOI as retain and under "other" and say pay
pursuant to contract or something similar
3. a few list retain and reaffirm; so presumptively some debtors are
reaffirming mortgage loans; although their attorneys should read Cliff's
excellent article.
Is there a consensus on this list re how to list mortgages on the SOI?
