That might be difficult. The other side wants mediation and thinks plaintiff should not have to incur expense of flying here from east coast. Also claims medical issues, but I have my doubts. If I can't get a stip, any ideas? File a motion? Stip is suppose to be filed Monday.

Meantime other party (plaintiff) says they refuse to fly here from out of state to attend mediation. Defendant does not want to do mediation now because plaintiff won't appear in person. Mediation was not "court ordered" however we now have a "scheduling order" saying we need to file a stip by a certain date since we agreed to mediate. How do I get relief from this? I don't want to violate a court order (this is MW who put the other atty in jail :-)
Ideas? Gotta be filed by Monday.

Maybe a joint stip not to attend mediation spelling out the reasons why it
doesnt make sense.
