Debtor 1 and Debtor 2 Separated and each are

If they filed a joint return for that tax year, the liability is joint and several. If you file one case for them, it's one tax liability. If you file two cases, it's two tax liabilities of the same amount. The question is really whether you can double the liability in one case; I don't believe you can.US Trustee doesn't have the right to split the tax liability, because each of the two owes it all. But in one case, they owe it only once.rather than one case.
