Hello Group,
I was recently in front of Judge Zurzolo on a 2nd Chapter 13 Filing within
one year of each other. It was brought to my attention I did not need to
file a Motion to Impose the Stay as it pertained to real property of the
debtor because Judge Zurzolo's stance was the 30-Day Automatic Stay in the
2nd case applied to the individual and not to the estate.
My question is - does Judge Klein share the same view?
I am again in a 2nd Chapter 13 filing within one year of each other and am
attempting to determine if I need to file a Motion to Impose the Stay. The
debtor in this case will be making postpetition DOT payments and payments
towards arrears thru the Plan Payments.
Thank you in advance for any insight to Judge Klein's opinion.
