Filing Under the New ECF

It's a .txt file which is autmoatically created by your BK preparation software at the same time it creates the creditor.txt file. We use EZ-Filing, but I know BestCase creates the same files. The debtor.txt file is a little hard to read on-screen with all the line breaks and codes, but it includes the debtor's name and address, and the dollar totals which we would otherwise have to manually input. If there's anyone who uses EZ-Filing and can't figure out how to do this, give me a call and I'll walk you through it.

I am so grateful to Lou for posting this e-mail back in March. Using the "Case Upload" method saves so much time from the old manual method of inputting cases. Curiously, I can find nothing in the ECF Manual discussing the Case Upload option. It appears to be a secret passed from attorney to attorney as part of a tribal ritual!

I think the request for a calculation of the total exemptions is especially onerous, and I wrote an e-mail to Maria Soria on Monday asking why it was necessary. I have not yet received a response.

Guess you should get better programs! I filed two 13's Monday with no
problems at all. EZFiling.

I also think this is very onerous for Debtor's counsel, and cannot imagine why we have to fill in these numbers if they're contained in the documents we e-file. Are all the districts requiring this? Fortunately my first two cases under this procedure were "business debt" cases, and like Hank I was able to skip most of the lines. Although Maria's e-mail said that the bankruptcy software companies should be able to insert this information automatically, our company (EZ-Filing) was not yet aware of the new requirement. If the rest of the CDCBAA membership agrees with Hank and I, I think a formal request should be made for changes to the procedure, or at least to open a dialogue. I'll volunteer to be part of any delegation.

On the Right side of the menu is a separate choice to Upload Case, an alternative to the Left side menu choice of open new case. By using the Right side choice you are prompted to upload the following files that meet the requirements: debtor.txt - creditor.txt - petition.pdf - credit.pdf. You must make sure that the petition.pdf file has everything attached for a complete filing. The credit.pdf is the separate credit counseling. The debtor.txt (or debtor.scn for some programs) contains the information needed for the ECF to populate its data fields. The creditor.txt has the addresses for the mailing matrix. There is no completing any other form. Since the changes in the ECF I have continued to use this menu choice and have not gotten any push back from the ECF staff.

I agree with Hank. I just finished filing a few under this new system. What a pain! Why in the world do they need a calculation of all the claimed exemptions. My program has never calculated the combined exemption total. More and more the clerks administrative duties are switched to the debtor's attorneys. We and our staffs have to spend more and more time to electronically file documents. It was much more efficient for my office when I would just make a few copies of the petition and schedules after the client signed, slap on a buck slip and check for the attorney service to file with the clerk. The net difference of electronic filing is two less copies of the petition being printed, and a great deal more time spent by my office on the process, the cost of which I cannot really pass along. It is frustrating...!

I just filed my first case using the new ECF Module / System.
I found the new statistic questionnaire a real pain and time consuming. It
looks like a 12 power scope for the UST to zero in on means test and other
issues. How do the rest of you feel about the new system? My client was
under the median income, so I was able to skip a lot of the questions, but
it takes longer to do that part, than it used to take to file the whole
case.
