A creditor filed an Adversary Complaint. The creditor stated a cause of action for Breach of Partnership and other non-BK causes of action. I am writing a Meet and Confer Letter to have him file a First Amended Complaint to eliminate those causes of action. But there will be some items that the court will have to rule on. The responsive pleading is not yet due. What is the rule regarding filing a First Amended Complaint, and can someone please post a sample Rule 12(b)(6) Motion?
