Bass and Associates is ramping it up

If they want to know if the debtor still possess the allegeded secured
property let Best Buys' rep identify the items and ask on the record at
the 341(a). I am not going have my client sign any statement of
non-possession. If my client bought the item as a gift like Best Buy
continuously encourages them to do in their advertising, Best Buy has
no enforeceable security interest in such gifted items. If Best Buy
sues my client for claim and delivery postdischarge without ever
confirming the client still had possession of the alleged items
postpetition, I am pursuing them for a discharge injunction violation
if my client did not have possession when the case was filed.
Almost every time I have demanded a proof of the allged secured
items, Bass & Associates could not produce documentation.

LOL, by the way, I went out of my way to be really polite with her, going so far as to tell her she was very professional and polite, and that I wasn't annoyed with her personally at all...BUT...
I should add though that when she asked about the TV from 2009, apparently even the Trustee rolled his eyes.....

I've been practicing BK over 25 years, the representatives change but the
pitch is the same. They are getting paid to show up and be annoying. They
are not getting paid to be reasonable. They figure that they get money or
promises a certain percentage of the time (new attorneys, pro pers) probably
their previous jobs were collection agents for Paydayloans. If Mannis
keeps being mean to them--they will stay away from his clients at least
until a new rep shows up.

Agree with Desiree...
My last encounter with them was with their 341A rep last Thursday. After telling the Trustee we'd chat with her off the record, we went outside and the conversation went like this:
"You really want a TV that was a gift to their daughter in 2009?"
"Yes, Best Buy is really going after these things"
"Good, then let's make a friendly bet. We bet that there is no way your counsel will file an action for replevin, get the judgment, apply for a writ, pay the sheriff and then actually go out of their way to pick up a used TV. Not to mention apply for relief from stay so as to not have to wait even longer. You apparently bet that they will. Let's see who wins. You can tell them you just met the world's most unreasonable attorney for all I care, but its not going to happen, and when you report back, you may absolutely quote me"
Today, I got a fax from them, a "Declaration of Non-Possession" for my clients to sign. So much for their stupid posturing. I suspect that if we all tell them to stick it, this will be rather short-lived.

When they call me, I tell them to go ahead and file the suit for claim and
delivery, obtain a judgment, obtain a Writ of Possession, and instruct (and
pay) the Sheriff to levy the Writ and then call me to obtain possession of

Bass and Associates is ramping it up

I got a letter from them last week for a debt of about $300.00 for a four
year old computer. Round one will be to ignore them. Round two will either
be ignore or offer them $1.00 U.S. Round three may be to offer the
collateral to see if they actually pick it up. I seriously doubt that they
would take the trouble to do so, but it will be an interesting test.
