When does an Annuity Become an Annuity?

Elder lady seeks to file Ch. 7. She dumped proceeds from sale of house ($156,000) in 10/2004 into a fixed deferred annuity. There is no periodic payment until she decides to start pulling money out. So, when is an annuity an Annuity and exempt under CCP 704.115?
