Eastern District also requires a declaration of consent from non-filing
spouse.

The first spouse who files gets to pick 703 or 704 exemptions. In San Diego the trustee would make you file a dec from the nonfiling spouse that the 703's were ok for both. See 703.110(c). You may be in for a battle. I don't know if there is an LA case were the two spoused fought over the exemption like this. Having one spouse pick 20k of property over the house his wife lives in is pretty crappy.
This is a tough one. Sometimes I just refuse to file this case. I don't want to represent a spouse who is willing to wipe out the other spouse.dennis
