Dear Friends and Colleagues:
For those of you familiar with arbitration in consumer disputes, you can
skip the next paragraph.
Consumer contracts typically contain arbitration clauses which require
consumers to go to binding arbitration to resolve any dispute with the
business that has wronged the consumer. Arbitration does not allow for
juries to hear the dispute and the arbitrators, who get all their business
from the businesses with whom the consumer has a dispute, are predisposed to
favor the business. There can be no appeals, no matter what mistakes the
arbitrator may have made. In addition, arbitrations require the parties to
the arbitration to pay the arbitrator by the hour for their work. This is
in addition to any attorney fees that each party pays to their attorney.
The use of our state and federal courts only require filing fees to be paid
for access. The judges are not paid by the parties to the dispute and one
may have their case heard by a jury of their peers. This right to access
the courts has been severely curtailed by the forced arbitration clauses in
consumer contracts.
There is now a bill in Congress to exclude consumer contracts from
arbitration. Please take a moment to look over the information below
regarding forced arbitration and sign the petition. It can be done
electronically and is very easy to fill out. Please pass it on to others to
sign.
