I sat through Judge Riblet's Confirmation calendar today in Santa Barbara. It was painful just to watch! Nevertheless I learned many things that I want to pass along.
1. Judge Riblet is strictly enforcing the local rules regarding the requirement for a paper copy of all fillings to be delivered to her Chambers for both electronic and manual filing. She is fining all attorneys $100 for failing to comply and provided stern lecture after stern lecture regarding attorney procrastination and failure to read the local rules.
2. Judge Riblet is strictly interpreting BAPCPA for plan confirmation regardless of I & J reflecting more disposable income despite the Chapter 13 trustee objections based upon additional disposable income in Schedules I & J.
3. Regarding LAM motions addressing totally undersecured junior trust deeds in Chapter 13 cases, Judge Riblet is addressing them through adversary proceedings not Motions. She is granting motions to suspend payments pending the outcome of the adversary proceeding.
