Subject: Judge Carroll's current procedure for Momods
Good afternoon Colleagues:
Please be aware that Judge Carroll has modified her Momod Procedure as
follows:
1. The momod must be filed with the Court;
2. After the notice time has expired and no party has filed an
opposition to the Momod,
the Debtor must forward a PDF copy of the momod to the Trustee for
the Trustee's Recommendation;
3. Upon receipt of the Trustee's Recommendation and Order, the
Judge will review the momod and will
grant the momod or set the matter for hearing. Note that the
lodging of the order triggers the
Court's review of the momod. To accomplish this end, this office
has presently programmed the mandatory
trustee recommendation form and order into the Trustee's database
system. Therefore, you will not need
to submit a trustee's recommendation form and order to the Trustee
as part of the PDF package.
