FYI....I just got off the phone with an aid from Congressman Anson Clark'soffice (in Detroit) soliciting my opinions on what kind of changes need to be
made statutorily (or otherwise) to make it easier to discharge student loans
and provide more certainty to the process.
I gave her my input for about 20 minutes, but referred her to NACBA/NCLC to get
more specifics and recommendations. If we, as a group, have anything specific
to add, I would suggest contacting our NACBA chair (whom I think is still David
Tilem) and providing said input.
I mentioned a few things like allowing the proceeding to be done by motionrather than adversary to make it more affordable for the debtor/client, and also
defining what undue hardship is in the code so it's not left so much up to the
judiciary, etc.
