They appealed to the BAP.
While I was writing this e-mail I was advised that the creditor filed an
objection to confirmation of the first amended plan in our case.
These are the facts:
We filed the plan with Miscellaneous Provisions and the addendum. The
Miscellaneous Provisions are those recommended by NACBA with some
modifications to make them easier to understand. The creditor files an
objection to both the Miscellaneous provisions and the addendum. We
write briefs and make arguments. The Judges take the briefs and
arguments under submission. At the confirmation hearing on April 28,
2009, the Judges issue a Memorandum stating that the debtor is to amend
the plan and strike A7 in the Addendum and that the case is confirmed.
The creditor is not present at the hearing. The confirmation order is
entered on May 13, 2009. The creditor appeals on May 13, 2009 and we
filed our first amended plan on May 19, 2009. Now the creditor has filed
an objection to our first amended plan with the April 28, 2009
addressing the same Miscellaneous Provisions originally objected to.
All I can say about the latest objection is...huh?
