Most judges ignore the Does, but think the attorney is an idiot for not knowing the federal rules.

Suggest you just answer for Smith. N.B. naming doe defendants is allowed in some district courts, including ours. See C.D. Loc. R. 19-1.

I would just ignore the Does (unless theyve paid you a fat retainer) and
file the answer on behalf of Mr. Smith. I dont think youll get a
complaint dismissed for having Does.

What does one do when the complaint names Mr. Smith, LMN, Inc. and Does 1-10
and you represent Mr. Smith? We don't have Doe pleading in federal court.
Is the entire complaint defective (i.e. Rule 12(b) motion)? Do you just
ignore the Does and answer for Mr. Smith?
