It went into effect on January 1, 2010. The homestead exemption for a head
of household or a married couple is $100,000 (unless they are over 65, etc.

They have lived in California for several years, and owned the house for several years. That is how they built up the equity. All 704 exemptions. Filed April 6, 2010. But the comment made me wonder if I missed something. I suppose the trustee maybe thinking we filed March 2010 or is not aware of the change.

Was that the new debt limits for Chapter 13 that went into effect April
1? Some of my legal knowledge is based on April Fool's Day, I know
that.

Did the case get filed after April 1, 2010? That's when the new
automatic homestead exemption amounts went into play, and that is $100k
for a "family unit" which certainly includes a couple cohabitating in
the dwelling for which the homestead exemption is claimed. If the
answer to sentence #1 is affirmative, you got me.

Is there any reason why a married couple cannot claim a 100K exemption in their principal residence ?
Trustee says he has an issue with it and continued 341 to next month.
