Stipulations
Let's stipulate that I don't know the answer to these two related questions:
1) Ellen Carroll case, Chapter 13, and before I even filed the AP to assess
home value and determine 2nd unsecured, the mortgage company stipulates on
the property value and their unsecured treatment in plan. I wasn't
expecting this stip until I did the AP. Once this is signed & filed, what
more do I need to do before the debtors can let go of the 2nd payments which
are breaking their back? (and anyone have a suggestion to those who are
way-late on 2nds, want to lien-strip but get EC?)
2) AP case where we brought action against creditor for violation of stay.
Just before trial, case was settled for undisclosed sum. Stipulation was
filed with court. What must be done procedurally to wrap up case,
paperwork-wise?
