Filing a Case where presumption arises

I am about to file a case where the presumption arises. The client has signed a waiver.
We have a good chance to beat it because debtor is a teacher who gets 10X per year.
(1) Do I need to file a "Debtor's Rebuttal of Abuse" at the same time of filing?
(2) If the Trustee tries to force a Chapter 13, can Debtor dismiss and file later when they pass the means test?
