FW: NCBJ Letter to Congress on mortgage modification bill

The New Legislation:
Rick Curry has made this letter about the proposed legislation available to
me, but it has general interest for all.
I have thought about writing such a letter which deals with other
ambiguities and problems caused by the new proposed legislation. One of the
issues I would raise is the 109(e) problem of treating yet to be stripped
liens as unsecured claims for debt limits purposes. The other is that
provision about consumer protection issues. I still can't tell whether that
is intended to confer jurisdiction on, or remove jurisdiction from the
Bankruptcy Court regarding such issues.
I would not want to write such a letter unless there is general interest and
Board of Directors approval. Naturally I would circulate the proposed
letter to the Board and membership before sending it off.
