This case is 180 degrees opposite of Judge Bowie's ruling in the Southern
District of California in the Johnson case. I have the same facts in a case
in which Judge Robles ruled in my clients' favor. The OUST filed a Motion
for Reconsideration and we have a hearing on 2/19. Wish me luck.

12/29/08 Eastern District decision - 707(b)(3) case holding that there's
abuse if the totality of the circumstances show the debtor could repay a
"substantial" portion of their unsecured debt. It's irrelevant whether they
