Good afternoon Colleagues:
Judge Carroll has made a few announcements in court recently that I wanted
to make sure the bar was aware of.
1. If your client is above median income, they will be required to
turn over all of their tax refunds for the entire applicable commitment
period i.e. five years;
2. If you file a motion to modify, you must concurrently lodge an
order with the court or the Judge will not be made aware of your motion to
modify prior to a TMD hearing;
3. You must obtain Trustee Comments after filing a motion to modify
or she will set your matter for hearing. Please forward a copy of your
MOMOD with the Trustee comments page filled out where appropriate and email
the documents to me after filing the MOMOD and lodging your order with the
court. Please also forward your MOMOD to Mecca at mmercado@ch13la.com;
4. If your client's charitable deduction expense is high (read this
as more than $100 a month) and your client's plan is less than 100%, the
Judge may look to your client's prior tax returns to determine what the
charitable expense will be limited to. (Thanks Keith!)
