Something a little different -- consumer suing business who is going

Consumer has claim against business (a collection firm, actually).
Claim arose in July 2009 but no suit filed.
Consumer's attorney knows potential defendant is filing bankruptcy
within the week.
Would it be better to file consumer's case BEFORE bankruptcy filed or
AFTER? Or doesn't it matter?
If it adds to the fun -- consumer's attorney believes there are assets
at firm but assets were probably hidden but there may be fraudulent
transfer claims strong enough to withstand discovery and even go to
trial with.
Oh -- FYI -- it's Mann Bracken. I don't think it's a secret, they are
telling a lot of people and this is most employee's last day.
