Client has an installment contract to purchase a burial plot. He has been
making timely monthly payments before and after BK. I received a letter
and a reaffirmation agreement from the Burial Plot company and they offered
3 options:
1. Client to reaffirm;
2. Client does not reaffirm but will continue to make payments and will
retain the property;
3. Surrender the property.
Should I treat it like a car? Have client signed the reaffirmation
agreement (not represented by attorney), no show at reaffirmation hearing.
I assume Court will deny motion. In the interim, client will continue to
make timely monthly payments. Is there any risk that the Burial Plot
company may foreclose since there is no Order approving the reaffirmation
agreement?
