Subject: [cdcbaa] Best efforts - Can we transfer the boat?
Judge says we can't keep the boat in the chapter 13 because it is incurring
a $510/month slip fee that should go to the unsecureds. Can debtor gift the
boat to her daughter so her daughter can take over the payments, or is there
some rule against transferring this asset out of the estate? Boat is
completely exempt.
What if title doesn't pass, but daughter of debtor just takes over the slip
fee payments as a gift to the debtor? Would that cause any problems in the
case?
Any ideas on how to structure this so we can get the plan confirmed without
other issues popping up? Debtor knows she will have to add the additional
$510 to her monthly plan payments.
Thanks,
