Dear list mates:
This may be a ridiculously simple question, for which I apologize in
advance.
In a Chapter 13 bankruptcy, does everyone on title to a house and its
secured loan need to jointly file Chapter 13 bankruptcy in order to come up
with a viable payment plan? For example, if both husband and wife are on
title to their primary residence, do they both need to jointly a Chapter 13
bankruptcy in order to obtain a reasonable payment plan that addresses both
the arrears as well as regular mortgage payment in order to save their home,
or can just one spouse file?
