Attached is the 9th Circuit BAP's 43 page decision affirming the 4 lowers court's holdings that the CDCA's Ch 13 Addendum does not violate USBC 1322(b)(2) or RESPA.
We will be putting out further information on this but the Addendum is alive and well (minus section A(7)) and everyone should be using it. It is the only protection you are giving your clients against the abuse being conducted in bankruptcy courts around the country. If anyone has any questions on why this addendum is important please call me directly.
Kudos go to Nancy Clark and Tara Twomey of NACBA for their hard work on this important issue
