OK, Ive postponed filing cases when early retirement distributions were received within the 6 month Means test window so that it fell off that time period in order to not trigger the 22A presumption, because I believe it is income that is counted.
But now Im doubting these determinations because I have a case where I cannot wait and it will force me into a 13 instead of a Chapter 7.If so, any way around it, such as giving it back it is within the timeframe to re-contribute (at the risk of a Dennis hyphenation demerit) it?
