Or arrange for a notarized response to the trustee's written
interrogatory (which I did once). That solves the proof of identity
issue.

Arrange with the Trustee to perform the Meeting of Creditors examination telephonically (many prisons have telephonic facilities for court appearances).

Barak:
In my experience the key to handling this situation is open communication with your trustee. Send an e-mail explaining the situation or reminding the trustee of the situation and follow up a few days ahead of the next hearing with that trustee's chapter 7 administrator. Giving them all the information that you have. Most trustees will accommodate an additional continuance beyond just one for good cause, and particularly where the spouse showed up and you are active in the case. I had one very professional trustee continue a hearing FIVE times where my client was gravely ill, and where we were very communicative with him about the situation all along.
If that doesn't work, I thought the new rule was that the trustee must actually move to dismiss for failure to appear, and you have some opportunity to oppose.

I have a client who was arrested and missed his 451a hearing. His wife was able to attend. He might not be released prior to the continued date for the Meeting of the Creditors. Any suggestions on how to keep the case from being dismissed?
