Dear listmates,
Help me read the proof of claim breakdown sheet for a mortgage.
The chapter 13 debtor had several properties and was at the edge of chapter
13 eligibility. However, according to the balances on monthly statements,
he was eligible.
Citi filed a proof of claim with a balance $74K larger than the
reinstatement balance. This pushed the debtor over the limits. The
principal is essentially the same in the reinstatement quote and the proof
of claim. However, the proof of claim has certain additional items that
add up to about $74K. The major ones are are:
Interest = $33K and
Escrow Advance Balance = $37K
These two add up to $70K
The date of the reinstatement quote was 10/28/2011
The date of filing was 11/2/2011
The date of POC was 11/30/2011
There was no mention in the reinstatement quote of either of these $30K
plus charges. Is this completely bogus?
