Filing c13 after reopening c7 re discharge violation

Debtor received discharge in chapter 7. Case closed. Later Debtor suffered
a discharge violation, reopened the closed chapter 7 case and is suing the
violator. In the meantime debtor was hoping to get a loan mod, but tomorrow
is the foreclosure sale date and the Debtor wants to file chapter 13.
Could there be a problem filing chapter 13 while the prior chapter 7 is
reopened to prosecute a discharge violation?
