Of course thats my worry. I am not concerned that she won't qualify because she has tried to commit suicide several times and her psychiatrist will provide letters to state that, we can get medical records as well. What I don't know is what type of documentation the trustees prefer to receive in a situation like this, and if anybody else has had the same situation. I prefer to send it to the trustee ahead of the 341 (a).

But are we risking the house? What if the $175k does not work and trustee pursue
to sell the house because dismissing the chapter 7 is not automatic?

Claim the exemption on Schedule C and see what the trustee does. If the trustee
objects, then you can ask the question again. Trustee will inquire at 341a,
presumably the disability payments will be submitted with the petition, andthere may not be any issue.
Is there really that much equity?

Thanks, there is that much equity. She's probably the only person in LA county who never refinanced, and is in her original home. Husband just died.

PC is 56 years old, but works for LAPD and does not pay into social security and is not eligible for SSI or state disability . However she is receiving disability from LAPD and has been considered not able to return to work ever because of mental and physical problems, and will get early retirement. How do I prove inability to engage in substantial gainful employment without the rebuttable presumptions in CCP704.730 B. She needs the $175,000 exemption and can show numerous 5150 and 30 day holds, etc. Will a doctor's letter be enough--or do they want to see medical records?
