Chapter 7 Maximum Fees

Attorneys fees is a very sensitive issue. I suggest that you look at the
amount of liability and the difficulties in the case. Usually, if a company
file Chapter 7, I will definitely charge more since I know the trustee will
look at it more. If there is a lot of creditors, I think it justifiy
charging a higher price since there is just more data entry and phone calls
that the attorney has to handle. If there is a state court litigation, then
it also justifies charging more. But if it is just a regular wage earner
making $2K per month that owes $40K to $50K credit card debts and has no
assets, then this type of cases should be the simplest type and should be
less costly. Hope this helps.

Each case is very individual and priced on a number of factors, and nothing in your email discussed any of them.
At some juncture I want to do an Excel spreadsheet that gives a base price and adds on for things like reaffirmations, notifications to state courts of stay of proceedings, etc. Sharing that if I ever do it may be price fixing so Ill be sure not to do that.

Seriously, I charge $5k for complicatedq cases. I charge more on rare occasions. I routinely charge 2500 to 3500 for debtors with businesses. 2k is not the cap for ch 7's

There is no maximum fee for a Ch7, The standard is "reasonable and necessary". If your fees are "excessive" -- be prepared to defend them against a UST's Motion to Disgorge.

Chapter 7 Maximum Fees

Robert, lighten up. Im sure it was a completely lighthearted joke. No one thought you were attempting to fix prices. David Tilem, in addition to being very expert also has a good sense of humor, as it as has been my pleasure to note during my years on this list.
Fees are a salient issue, and Id be happy to speak with you off list about it. It is hard to know how to set your fees in Chapter 7, and David Tilem knows that the very few lines you wrote cannot possibly be any attempt to fix prices. Each case is very individual and priced on a number of factors, and nothing in your email discussed any of them.
At some juncture I want to do an Excel spreadsheet that gives a base price and adds on for things like reaffirmations, notifications to state courts of stay of proceedings, etc. Sharing that if I ever do it may be price fixing so Ill be sure not to do that.
