When you say "retainer," I take it you mean that compensation is collected
after the work is done separate and apart from the bankruptcy charges or
have you figured out a way to charge a retainer up front in compliance with
the law?

I hate to say this because it often irritates me when I hear it from others
but I think that it is borderline malpractice to refer a client to a loan
modification "firm" at this point. Most of the time you are setting them up
to be defrauded. It is difficult to believe that any of them are in
compliance with SB 94. So, they are acting outside of the law. There may
be legitimate people doing them but I don't know of any. All of the lawyers
that I know who used to do them have stopped as a result of SB 94 and the
futility of it. The ones that are left make false promises and provide a
service which has little value. Moreover, it is clear that hiring someone
to represent you in a loan modification does not increase your chances of
getting one. It is just a waste of money that the client won't have when
the loan mod is ultimately denied and the client needs to take legal action.
If they just need help filling out the forms, I refer them to the HUD 800
number and/or website. HUD has several places set up to help people fill
out the forms. I usually tell them not to spend any money on a loan mod and
to come back after it is denied so that I can file a bk or civil action for
them.
