My understanding has been that payments to underwater residential seconds end as of entry of 506(d) judgment, not confirmation, in EC cases. Is there a new local lcoal rule?

Nancy Curry's judges are recommending that IF the case is not ready to go at the 341(a) then it be set out 4-6 months to allow the bar date to pass. At the time of the later cf hrg it is either confirm or dismiss. This greatly cuts down on the # of hearings -- but also often delays atty fees from being paid. Therefore, good attys should be asking for more of the atty fees up front. Bad attys, paralegal run firms, hands-off attys etc., should provide for more of their atty fees in the plan so that their work can be properly reviewed by the court and the trustee.

Gosh, change the admin percentage to 100% of plan payments and get a fat check
the month after confo. The change is to have the claims bar date run before
confo. We can work with this. Keep in mind, we have a judge who fights low
percentage payouts to unsecureds. If the bar date runs prior to confo, the
unfiled claims raise the percentage. EC will, however require payments to
unsecured seconds until this confo.
