You are seriously over-reacting. It is bad enough that we have the Court
all but standardizing the fees for us in Chapter 13 cases. We have to be
careful not to stray into accidentally setting fee standards in Chapter 7
cases.
I did not question your personal ethics or your personal standards. It was
just a glib response designed to ward off any discussion in what I perceive
to be a questionable area.
If you are seriously concerned, please give me a call and we can get
together for lunch to discuss it.

I always have appreciated your efforts in the past to provide aid to other
members of the listserv. I, myself have been the beneficiary of such advice
on a number of occasions and have expressed my gratitude to you. In good
faith, I have even attempted to return the favor to you.
However, I take considerable exception to your implication that I am
attempting to "fix prices".
(1) I specifically asked if anyone knew of a statutory basis regulating our
fees. I even referenced sources I have already exhausted regarding the
matter. It seems to me a reasonable and ethical query.
(2) I then added my belief regarding the market.
(3) In order for your glib accusation to be given weight, a number of things
would have to be true: (a) the above (1) and (2) would need to be a request
on my part to communicate a conspiracy as to fees (b) each and every BK
attorney in my district would need to be party to the list serv (or at least
a substantial number of them)...cdcbaa's numbers are big, but a number of
attorneys do BK and do not belong to cdcbaa....(c) I would need to be stupid
enough to post this conspiracy in a permanent public forum.
(4) I entered Bankruptcy because of my ethics not inspite of them. I worked
in far more affluent areas of the law (M&A, Family Law and Business
Litigation) but left them because I did not feel that they were in line with
my moral makeup. As a result, I started my own firm. I (and my family)
regularly go without so as to provide aid to my clients. These allowances
range from nights and weekends to less money for food and clothes while I
get my practice off the ground.
(5) My rates are EXCEPTIONALLY competitive and incredibly fair. It was my
desire to fulfill my duty of fairness to my clients that prompted my
question, not an attempt to circumvent it. I refer you to my website for a
transparent listing of my fees.
(6) All that I have in this life is my word...your unwarranted implicit
remarks concerning my character and actions are well beneath you...but I am
sure you did not mean them that way.
If you would like, you are welcome to contact me off the list serv as I am
not sure this is the appropriate place to escalate our exchange.
