To me, this is analogous to a "business" where only the NET would be above
the line, counted towards the median income. Then again, the question
presumes that you're treating the sister as a "dependent" and part of the
household size, which need not necessarily be the case. Not sure why I'm

A recent client inadvertantly failed to disclose that he receives IHSS
payments for the care of his blind and disabled sister. He nets slightly
over $500 per month and spends about $360 of that for his sister's care and
needs. I know I will have to amend Sch's I&J, the means test and the Ch13
plan.
Question is where can I show the extra payments for the sister's care on the
means test not to trigger an "abuse" presumption. I understand that the
debtow will most likely have to increase his plan payments by the "net" he
gets from the IHSS payments (about $160 per month).
Should I also plan on preparing a declaration to explain this item for the
341 hearing?
